Grazie a Glorioso per la segnalazione. 

Noto che si sono liberamente ispirati alla Open Software License (nota anche 
come Academic Free License; č la licenza con cui OSI rilascia i contenuti 
del proprio sito). 

Questa licenza ha una caratteristica: specifica il *foro competente* e la 
*legge applicabile*: 

"Jurisdiction, Venue and Governing Law.
Any action or suit relating to this License may be brought only in the 
courts of a jurisdiction wherein the Licensor resides or in which Licensor 
conducts its primary business, and under the laws of that jurisdiction 
excluding its conflict-of-law provisions. The application of the United 
Nations Convention on Contracts for the International Sale of Goods is 
expressly excluded. Any use of the Original Work outside the scope of this 
License or after its termination shall be subject to the requirements and 
penalties of the U.S. Copyright Act, 17 U.S.C. § 101 et seq., the 
equivalent laws of other countries, and international treaty. This section 
shall survive the termination of this License.". 

Nella European Union Public Licence troviamo: 

"14. Jurisdiction
Any litigation resulting from the interpretation of this license, arising 
between the European Commission, as a Licensor, and any Licensee, will be 
subject to the jurisdiction of the European Court of Justice, as laid down 
in article 238 of the Treaty establishing the European Community.
Any litigation arising between parties other than the European Commission,
and resulting from the interpretation of this license, will be subject to 
the exclusive jurisdiction of the competent court:
· where the Licensor resides or conducts its primary business, if Licensor
resides or conducts its primary business inside the European Union;
· where the Licensee resides or conducts its primary business if Licensor
resides or conducts its primary business outside the European Union;
· where the Licensor resides or conducts its primary business, if both the
Licensor and the Licensee reside or conduct their primary business outside
the European Union. 

15. Applicable Law
This License shall be governed by the law of the European Union country
where the Licensor resides or has his registered office.
This License shall be governed by the Belgian Law if a litigation arises
between the European Commission, as a Licensor, and any Licensee.
This License shall also be governed by the Belgian Law if the Licensor has 
no residence or registered office inside a European Union country.". 


Anche la Q Public License presenta questo tipo di clausola, e in termini 
molto meno flessibili: 

"This license is governed by the Laws of Norway. Disputes shall be settled 
by Oslo City Court". 

Trattasi di licenze che FSF ed OSI indicano espressamente come *licenze 
libere*. Eppure, se non erro, mi sembra di avere letto su questa lista che 
questo tipo di clausole sarebbe restrittivo della libertā e che dunque 
siffatte licenze non sarebbero libere.
Sono un po' confuso...
